New Delhi, August 20, 2024 : The Supreme Court of India, led by Chief Justice of India (CJI) D.Y. Chandrachud, has issued a stern rebuke to the West Bengal Government, urging restraint in its handling of peaceful protesters. The court’s remarks came during a hearing on a case concerning the state government’s response to ongoing protests and its management of a crime scene.
In a scathing critique, CJI Chandrachud admonished the West Bengal Government, highlighting the importance of maintaining law and order without infringing on the rights of peaceful protesters. “The power of the state should not be unleashed on peaceful protesters,” the CJI stated, emphasizing that the government’s primary role is to protect, not suppress, those exercising their democratic rights.
The court’s comments also extended to the recent administrative actions taken by the state, specifically concerning the appointment of the principal of RG Kar Medical College and Hospital. The CJI expressed astonishment over the state’s decision to transfer the principal to another college while the individual’s conduct was still under scrutiny. “When the conduct of the RG Kar Hospital’s principal was under scrutiny, then how was he appointed to another college immediately?” CJI Chandrachud questioned, suggesting that the move undermines the integrity of the investigation.
Further, the CJI criticized the West Bengal Government’s handling of a crime scene that had become a focal point of the protests. He pointed out the state’s failure to safeguard the location, expressing confusion over why it could not adequately maintain law and order in such a critical situation. “West Bengal Govt was expected to maintain law and order and protect the crime scene, unable to comprehend why the state could not do so,” he remarked.
The Supreme Court’s observations reflect growing concerns over the West Bengal Government’s approach to both civil rights and administrative governance. The court’s directives are expected to prompt significant introspection within the state administration as it navigates the complex challenges of upholding law and order while respecting democratic freedoms.
