The court said that the oral and documentary evidence collected by the ED reveals that the accused is a close associate of (former Deputy CM Manish) Sisodia and was involved in “every stage of making the excise policy”
A Delhi court Friday sent Dinesh Arora, co-accused in the Delhi excise policy case, to the custody of Enforcement Directorate (ED) till July 11. Arora was arrested by the ED on Thursday.
Justice MK Nagpal of the Rouse Avenue Court said: “… in considered opinion of this court, besides his sustained interrogation on certain facts not completely or truthfully found to have been disclosed by him in his previous statements, his custodial interrogation also becomes necessary in light of the above oral and documentary evidence collected by the investigating agency…some legitimate and reasonable explanation is required by him…”
An application was moved by the investigating officer seeking ED custody of the accused for a period of seven days under section 167 CrPC read with section 65 of the PMLA (Prevention of Money Laundering Act) 2002.
The court said that the oral and documentary evidence collected by the ED reveals that the accused is a close associate of (former Deputy CM Manish) Sisodia and was involved in “every stage of making the excise policy”. It further stated that he was allegedly present in meetings with the co-accused.
Relying on the evidence presented by ED, the court also said that he was “personally involved in handling or transmission of advanced kickbacks amount of around Rs 35 to 36 crore.”
On Arora’s application seeking that the grounds of his arrests be furnished, the court said the request “is not found legally tenable as it has been observed that section 19(1) of the PLMA nowhere provides or requires that the accused is entitled to be furnished the grounds of his arrest.”
